NOTICE RULE

120 days, with the reason

Fla. Stat. § 627.4133(2)(b)

For a personal-lines residential property policy, including a homeowners policy, the insurer must give the first-named insured written notice of nonrenewal, cancellation, or termination at least 120 days before the effective date. The notice must include the reason. Cancellation for nonpayment of premium is a 10-day written notice with the reason. The same section has a shorter clock for some cancellations early in the policy. Read the subsection that matches your letter before you count on any other number. Other timing rules in § 627.4133, including what happens if notice is late, should be read on the statute page.

Insurer of last resort

Citizens Property Insurance Corporation. Citizens is Florida’s residual market, not a typical voluntary carrier. On 4 March 2026 Citizens said regulators approved an average 8.8% decrease for homeowners multiperil policyholders and an average 5.5% decrease for homeowners wind-only policyholders, with at least a 2% decrease for all personal-lines policyholders. The rates take effect 1 July 2026 for new policies and at renewal for policies already on the books. Citizens said its policy count was 336,000, down 76% from a peak of 1.41 million in October 2023. A PIPSO fiscal-year 2024 table republished by Triple-I still shows 1,321,953 Florida habitational policies; that is an earlier snapshot, not a contradiction of the March 2026 count. A January 2026 CFO release described an 8.7% statewide average Citizens reduction. Use Citizens’ own 8.8% multiperil figure for the multiperil program, and treat 8.7% as the administration’s earlier statewide description. [24][25][22]

What to do with the notice

  1. Find three dates: the date the notice was mailed, the date the policy expires, and the date the company says coverage ends.
  2. Read the reason. “Underwriting reasons,” with nothing under it, is not an explanation you can appeal or fix.
  3. Decide which letter you have. A nonrenewal, a mid-term cancellation, and a renewal that cuts coverage or raises the price are different notices, and states time them differently.
  4. Keep paying the current policy until a new one is bound. A gap can put a mortgage into force-placed insurance, which protects the lender first.
  5. Ask the company, in writing, for the declarations page, the replacement-cost estimate, and which rating factors changed.
  6. If a mortgage company is on the policy, tell them you are replacing coverage before the old policy ends.
  7. Shop admitted insurers. If you cannot find one, use the residual-market note on your state page. A FAIR plan or Citizens policy is often narrower than the policy you had.
  8. Compare deductibles before you accept a lower premium. A percentage hurricane or wind deductible is a share of the dwelling limit, not a flat $1,000.
  9. If the notice looks late or states no real reason, complain to the state insurance department and keep the envelope or the electronic-delivery record.
  10. Ask about a mitigation credit only where the company will put the discount in writing: a new roof, opening protection, or defensible space, depending on the peril.
